BUSINESS CERTIFICATE
  Do you operate your business using a "trade name?" If you use a name other than your own (or you use a name other than your corporate name), such as a D/B/A (Doing Business As), you must file a Business Certificate in the city or town your business is located. Did you know you must file a new certificate every FOUR years? If you do not file or refile the Business Certificate, you may be subject to a substantial fine and other legal problems related to your business. It does not cost a lot of money to register the name, but the costs of non-filing can be astronomical.

SELF-EMPLOYED RETIREMENT PLAN
  If you carry on a trade or business as a sole proprietor, a member of a partnership, an independent contractor or you are otherwise in business for yourself, you are considered to be self-employed and can participate in a retirement plan for yourself. Part-time work, work done at home, even in addition to a regular job, may also be self-employment. You can take a tax deduction for contributions made to your self-employed retirement plan. Like the "big companies," a self-employed must provide coverage for all full-time employees who are at least 21 years of age and have one year of service (at least 1,000 hours). You must establish the plan before the end of your tax year (usually by December 31) by signing plan documents and making a minimum contribution. Contributions can be made up to the due date of the related income tax return (or extended due date) and still be deductible in the year accrued. There are limits to the maximum amount that can be contributed and other limitations and restrictions do apply.

DRIVING AND DRINKING DON'T MIX
  This is a poem received last year from my friend Mark Gulko, also a CPA. Read it and be responsible.

I went to a party, Mom, I remembered what you said.
You told me not to drink, Mom, so I drank soda instead.
I really felt proud inside, Mom, the way you said I would.
I didn't drink and drive, Mom, even though the others said I should.

I know I did the right thing, Mom, I Know you are always right.
Now the party is finally ending, Mom, as everyone is driving out of sight
As I got into my car, Mom, I knew I'd get home in one piece.
Because of the way you raised me, so responsible and sweet.

I started to drive away, Mom, but as I pulled out into the road,
the other car didn't see me, Mom, and hit me like a load.
As I lay there on the pavement, Mom, I hear the policeman say,
the other guy is drunk, Mom, and now I'm the one who will pay.

I'm lying here dying, Mom. I wish you'd get here soon..
How could this happen to me, Mom? My life just burst like a balloon
There is blood all around me, Mom, and most of it is mine.
I hear the medic say, Mom, I'll die in a short time.

I just wanted to tell you, Mom, I swear I didn't drink.
It was the others, Mom. The others didn't think.
He was probably at the same party as I.
The only difference is, he drank and I will die.

Why do people drink, Mom? It can ruin your whole life.
I'm feelings sharp pains now. Pains just like a knife.
The guy who hit me is walking, Mom, and I don't think it's fair.
I'm lying here dying and all he can do is stare.

Tell my brother not to cry, Mom. Tell Daddy to be brave.
And when I go to heaven, Mom, put "Daddy's Girl" on my grave
Someone should have told him, Mom, not to drink and drive.
If only they had told him, Mom, I would still be alive.

My breath is getting shorter, Mom. I'm becoming very scared.
Please don't cry for me, Mom. When I needed you, you were always there

I have one last question, Mom, before I say good bye.
I didn't drink and drive, so why am I the one to die?

Greeting SIR Brother Roger

This is really strange, that this poem should come back to me, because it was I that started this poem in circulation over a year ago.

I am a teacher and this was given to me by one of my students. I had posted this to an organization called SCHOOLNET, an organization sponsored by the Canadian Government. I guess what really goes around, comes around! Isn't life really strange?

De WHAT????
  This is from my Web surfing friends Phil and Shirley:

If lawyers are disbarred and clergymen defrocked, doesn't it follow that:
Electricians can be delighted,
musicians denoted,
cowboys deranged,
models deposed and
dry cleaners depressed?
Laundry workers could decrease, eventually becoming depressed and depleted. Even more, bed makers will be debunked,
baseball players will be debased,
landscapers will be deflowered,
bulldozer operators will be degraded,
organ donors will be delivered,
software engineers will be detested,
the BVD company will be debriefed,
and even musical composers will eventually decompose.
On a more positive note, though, perhaps we can hope politicians will be devoted.

Here's hoping your hard drive is never defiled.

KEEP IT IN GOOD CONDITION
  Most of us want to keep our vehicle in good working order. Here are just a few suggestions for you:
  1. Check all fluid levels, including oil, windshield wiper, transmission and engine coolant.
  2. Rotate and check the air pressure of all tires (don't forget the "spare").
  3. Inspect and replace worn belts and hoses.
  4. Replace missing or stolen items and repair damaged items.
  5. Wash and wax your vehicle to protect the paint finish.
  6. Go to Mike's Automotive (328 North Main St., Randolph, 781-961-5550) and check all moving parts. You will feel better and should be ready for the summer trips. (Mike is my son Michael, the owner of Mike's Automotive. Just tell him "dad sent me.")

MUTUAL FUNDS WITH CHANGING SHARE VALUE
  Do you have money invested in a mutual fund that changes share values each day, week or month? A money market account usually has a value of $1 per share at all times. If so, you must save ALL annual statements of those accounts from the date of original purchase. Each time you write a check or withdraw funds from a changing value mutual fund, you are creating a sale of a security that must be reported on your income tax return. This may be enough of a burden, but, you must also know the cost basis of EACH share sold. That means keeping detailed records of each share purchased through deposits made into the account, dividends reinvested (more shares purchased) and all sales (withdrawal of shares). Save yourself a lot of aggravation by using a money market account for check writing purposes and the "floating price-per-share" account for those rare withdrawals.

ALIMONY
  Question: "Is alimony deductible when paid by me?

Answer: Generally, alimony is deductible by the person who pays it and taxable income to the person that receives it. However, child support is neither deductible by the payor nor is it taxable to the recipient.

DO YOU HAVE A WILL?
  What would you do if your parents died without leaving a will? Who will be responsible for you, your brothers and sisters? What will happen to your parent's bank accounts and other property including their home or the old car? As many as 70% of adult Americans do not have a Last Will and Testament. Apparently, they do not think they need one. Maybe they think they will live forever. A will is not necessarily as complex as some may think. You don't have to be wealthy to need a will. The most important purpose of a Will is to know that your possessions will be distributed the way YOU want them to be. What about your minor children? Who will take care of them after you are gone? Who will make sure your final wishes are carried out? You can get the answers to these and many other questions about the Last Will and Testament, Living Wills and Health Proxies by contacting your attorney and about estate planning by calling your CPA.
